1 Scope of application
These General Terms and Conditions for Room Bookings ("GTC") apply to Gasthaus Traube AG (hereinafter referred to as the Hotel) in Buchs SG for the provision of hotel rooms for the accommodation of individual and group travelers, as well as all related services, events and functions provided by the Hotel. These GTCs form the basis of the legal framework for every reservation. The general terms and conditions of the guest shall not apply.
2 Conclusion of contract
After the guest has made a reservation, he will receive a written reservation confirmation from the hotel. With this written confirmation to the guest, an individual reservation contract between the parties comes into force.
An individual reservation without a guarantee is valid until 16:00 on the day of arrival. With a room guarantee, your reservation remains valid for the whole night even if you arrive after 16:00.
Guarantees for a room reservation are
Credit card (Visa, American Express, mastercard)
Advance payment for one night, e.g. by credit card, bank or postal transfer
Deposit according to section 6
Written guarantee from a company registered in the commercial register, based in Switzerland
An offer for group reservations is explicitly designated as such and must be signed by the guest and returned to the hotel. An offer is valid for seven days (acceptance period). This means in particular that offers, price lists and the like issued by a hotel do not constitute a binding offer.
The Gasthaus Traube expressly reserves the right to put the rooms back on sale during and after the acceptance period for the offer for group reservations has expired. In the event of a renewed request, the new offer may contain deviations from the first offer.
3. services and prices
The hotel undertakes to provide the services booked by the guest and confirmed in writing by the hotel.
All prices are quoted in Swiss francs (CHF) and include the statutory value added tax (VAT).
4. room handover and return
Booked rooms are available to the guest from 14:30 on the agreed day of arrival. The guest is not entitled to occupy the room earlier.
On the agreed day of departure, the rooms must be vacated and made available to the hotel by 10:30 a.m. at the latest. If the rooms are vacated later than 10:30 a.m. without the hotel's permission, the following costs will be charged:
- Free of charge until 12:00 noon
- From 12:00 to 16:00 CHF 40
- From 16:00 CHF 130.--
If unexpected circumstances make it impossible to provide the hotel rooms booked in advance, the hotel is obliged to organize accommodation in a hotel of a similar room category and comparable quality. In addition, the hotel shall bear all costs associated with the reorganization, such as transport costs and the price difference between the booked rate and the price of the alternative accommodation.
5. payment
a. Payment Hotel
Hotel invoices without a due date are payable in full within 30 days of receipt of the invoice. The hotel is entitled to declare accrued claims due at any time and to demand immediate payment.
The hotel is entitled to demand an appropriate advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and the payment dates will be announced with the offer.
If the guest is resident abroad, the hotel reserves the right to debit the entire invoice amount from the guarantee credit card. Any exchange rate differences or bank charges shall be borne by the guest.
b. Payment for events and functions
On request, we will prepare an invoice after the event. For this purpose, we request that the billing address be provided in advance.
6 Cancellation conditions
a. Cancellation conditions for individual reservations
Individual reservations are normally considered definitive once the offer has been confirmed by the Gasthaus Traube. In the event of a last-minute withdrawal after the cancellation deadline, one night's accommodation may be charged at 100%.
For certain rates, special conditions apply, which no longer allow for a cancellation. However, unless otherwise stated, the following conditions apply to individual reservations:
Changes and cancelations are free of charge up to 72 hours prior to arrival, after which the total amount of the stay will be charged to the credit card on file. No shows will be charged in the amount of the total price of the stay. The hotel will waive cancellation fees for nights that can be resold.
For long term stays of more than 20 nights, a non-refundable deposit of one third of the total cost is required four weeks prior to arrival.
b. Cancellation conditions for group reservations
For group bookings of five rooms or more, a deposit of one third of the total cost is required four weeks before the date of arrival. Changes or cancelations are free of charge up to 72 hours before arrival. After this time, changes and cancelations will be charged at 100% of the booking value.
c. Cancellation conditions for events and functions
The event can be canceled free of charge up to seven days in advance. After this time, 100% of the costs for pre-ordered meals will be charged.
7 Withdrawal by the hotel
If an agreed advance payment is not made even after a reasonable grace period set by the hotel has expired, the hotel is entitled to withdraw from the contract.
If the service to be provided by the hotel in accordance with this agreement is made significantly more difficult or impossible in whole or in part due to force majeure or other circumstances beyond the hotel's control, the hotel may withdraw from the contract in whole or in part up to the amount of the unfulfilled part of the contract without compensation.
Furthermore, the hotel is entitled to withdraw from the contract extraordinarily for objectively justified reasons, for example if
the room is booked under misleading or false statements of material facts, e.g. in the persons of the customer or the purpose.
